Waste Collection West Hampstead Service Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste collection and related services in West Hampstead and surrounding areas. By making a booking, confirming a quotation, or allowing our operatives to commence work at your premises, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you must not use our services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the following meanings:

1.1 Service means any waste, rubbish or junk collection, removal, loading, transportation, clearance or related activity provided by us.

1.2 Customer, you or your means the person, business, landlord, tenant, or organisation that requests or uses the Service.

1.3 We, us or our means the waste collection service provider operating under the name Waste Collection West Hampstead.

1.4 Premises means the property, building, land or location where the Service is to be carried out.

1.5 Waste means the items, materials or rubbish that you ask us to collect, dispose of, recycle or remove as part of the Service, excluding any prohibited or hazardous items not agreed in advance.

2. Scope of Service

2.1 We provide waste collection and related services primarily within West Hampstead and neighbouring areas. Service availability may vary depending on access, vehicle restrictions, and scheduling capacity.

2.2 The specific details of the Service, including the type and estimated volume of Waste, the date and time of collection, and any additional work required, will be agreed with you during the booking process and confirmed in your quotation or booking confirmation.

2.3 We reserve the right to refuse to collect any Waste that we reasonably believe to be hazardous, restricted, illegal, excessively heavy, unsafe to handle, or materially different from the description provided at the time of booking.

3. Booking Process

3.1 Bookings may be made by phone, email or through our online enquiry channels where available. All bookings are subject to availability and our acceptance.

3.2 When making a booking, you must provide accurate and complete information, including but not limited to:

(a) your full name and contact details;
(b) the address of the Premises and any access restrictions;
(c) a clear description of the Waste to be collected;
(d) any items that may require special handling; and
(e) your preferred date and time for collection.

3.3 Any quotation provided before our arrival is based on the information you supply. If, upon arrival, the actual quantity, type or location of the Waste differs from what was described, we may revise the quotation, adjust the scheduled work, or decline to proceed with all or part of the Service.

3.4 Your booking will be confirmed once we have accepted your request, agreed a time slot, and, where required, received a deposit or pre-authorisation in accordance with section 4.

4. Prices, Quotations and Payments

4.1 Our charges are usually based on the volume, weight, type and handling requirements of the Waste, as well as the time taken to complete the Service and any additional services requested.

4.2 Any quotation provided prior to collection is an estimate only, based on the details you supply. The final price will be confirmed on site once our operatives have assessed the Waste and the access conditions.

4.3 We reserve the right to charge for additional labour, waiting time, extra journeys, or unforeseen work where circumstances at the Premises differ from those described at the time of booking.

4.4 Unless otherwise agreed in writing, payment is due in full upon completion of the Service on the day of collection. We may, at our discretion, require a deposit or full prepayment prior to the Service.

4.5 We accept payment by approved debit or credit cards, bank transfer or cash, subject to the options we make available at the time of booking.

4.6 Where the Customer is a business or organisation and we agree to provide credit terms, invoices must be paid in full within the period stated on the invoice. We reserve the right to charge interest on overdue amounts in accordance with applicable law.

4.7 All prices are stated exclusive of any applicable taxes, which will be added at the prevailing rate where required.

5. Cancellations, Rescheduling and Access

5.1 You may cancel or reschedule a booking by giving us reasonable notice prior to the agreed arrival time.

5.2 If you cancel less than 24 hours before the scheduled time, we reserve the right to charge a cancellation fee to cover any costs incurred, including administration, travel, or lost booking opportunities.

5.3 If our operatives attend the Premises at the agreed time and are unable to gain access, are unable to contact you, or are otherwise prevented from carrying out the Service due to reasons within your control, we may treat this as a late cancellation and charge a call-out or cancellation fee.

5.4 We will use reasonable efforts to attend at the agreed time, but time is not of the essence. We are not liable for any delay caused by traffic, weather, vehicle breakdown, staff illness, or other circumstances beyond our reasonable control. In such circumstances, we will endeavour to reschedule the Service as soon as reasonably practicable.

6. Customer Obligations

6.1 You are responsible for:

(a) ensuring that our operatives have safe, clear and reasonable access to the Premises and the Waste;
(b) providing accurate information about the Waste and any risks associated with it;
(c) notifying us in advance of any parking restrictions, loading restrictions or access limitations;
(d) obtaining any necessary permissions, permits or consents required for us to carry out the Service at the Premises; and
(e) supervising our operatives where the Premises contain valuable, fragile or sensitive items not forming part of the Waste.

6.2 You must not include in the Waste any items that are hazardous, explosive, toxic, corrosive, infectious or otherwise dangerous, unless we have expressly agreed in writing to handle such items and you have complied with all applicable regulations for their safe collection and transport.

6.3 If you are a landlord, agent or business booking on behalf of a third party occupant, you warrant that you are authorised to do so and that these Terms and Conditions are binding on the party benefiting from the Service.

7. Waste Handling, Recycling and Disposal

7.1 We will handle, transport, recycle and dispose of Waste in accordance with applicable UK waste management legislation and regulations.

7.2 We or our authorised partners will hold the relevant licences, registrations or permits required to carry out the collection, transfer and disposal of controlled waste.

7.3 By using the Service, you confirm that you are the owner of the Waste or that you have the authority of the owner to arrange its removal, and that the Waste does not include any item obtained illegally.

7.4 We will use reasonable endeavours to maximise recycling and recovery of materials where commercially and operationally viable, but we do not guarantee that any particular proportion of Waste will be recycled.

7.5 Once the Waste has been loaded into our vehicle and the Service is complete, ownership of the Waste transfers to us or our authorised waste management partners, subject to compliance with relevant regulations.

8. Liability and Limitations

8.1 We will exercise reasonable care and skill in providing the Service. However, you acknowledge that the removal of waste, bulky items and general rubbish may carry inherent risk to surrounding surfaces, fixtures or fittings, especially in confined spaces.

8.2 We are not liable for any pre-existing damage, wear, defects or fragility at the Premises, or for damage that arises from moving items through narrow corridors, stairwells or access points where you have requested that we proceed despite the obvious risk of damage.

8.3 Our liability for direct loss or damage to your property caused by our negligence shall be limited to the reasonable cost of repair or replacement, subject to a fair assessment of evidence and depreciation.

8.4 We are not liable for:

(a) any loss of profits, business interruption, loss of data, or loss of opportunity;
(b) any indirect or consequential losses; or
(c) any loss arising from delays or cancellations due to circumstances beyond our reasonable control.

8.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.

8.6 You agree to indemnify us against any claims, costs, losses or liabilities arising from your breach of these Terms and Conditions, including but not limited to losses arising from your failure to disclose hazardous or prohibited items, or your failure to obtain necessary permissions for us to access and work at the Premises.

9. Complaints and Disputes

9.1 If you are dissatisfied with any aspect of the Service, you must notify us as soon as reasonably possible, and in any event within 48 hours of completion, providing clear details of your concerns.

9.2 We will review your complaint and may request additional information or evidence. Where appropriate, we will seek to resolve the issue through repair, partial refund, re-performance of the Service, or another suitable remedy, at our discretion and in accordance with your statutory rights.

9.3 If a dispute cannot be resolved informally, both parties agree to attempt resolution through negotiation or, where applicable, an alternative dispute resolution scheme before commencing court proceedings.

10. Insurance

10.1 We maintain insurance cover appropriate for the nature of our waste collection activities, including public liability insurance at levels we reasonably consider adequate.

10.2 Our insurance cover is subject to the terms, conditions and exclusions of the relevant policy. You may request confirmation of our insurance upon reasonable notice.

11. Data Protection and Privacy

11.1 We will collect and process personal information about you as necessary to manage bookings, provide the Service, handle payments and meet our legal obligations.

11.2 We will take reasonable steps to keep your personal data secure and to use it only for legitimate business purposes, in accordance with applicable data protection laws.

11.3 By using our Service, you consent to the collection and use of your personal information as described in this section. You may contact us at any time to request access to, correction of, or deletion of your personal data where legally permissible.

12. Amendments to these Terms

12.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices, or the nature of the Service.

12.2 The version of the Terms and Conditions that applies to your booking is the version in force at the time your booking is confirmed. Any subsequent changes will not apply retrospectively to confirmed bookings unless required by law.

13. Severability

13.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall, to the extent required, be deemed deleted, but the remaining provisions shall continue in full force and effect.

14. Entire Agreement

14.1 These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or agreements, whether oral or written.

14.2 You acknowledge that you have not relied on any statement, representation, assurance or warranty not expressly set out in these Terms and Conditions.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or with the Service shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.
